These Terms of Use ("Terms") govern your access to and use of the Inktrue website and rent value report service (the "Service"), operated by Inoak Chapman Street, LLC ("Inktrue," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Inktrue lets you create an account, submit information about a property through a question form, and receive a rent value report. To generate your report, we combine the information you submit with data obtained from third-party APIs, run our own calculations, and deliver the resulting report to you as a PDF by email. The Service is currently provided to users free of charge.
You must provide accurate and complete information when creating an account, and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization.
You agree not to: (a) submit false or misleading information through the question form; (b) use the Service for any unlawful purpose; (c) attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems; (d) reverse engineer, scrape, or misuse the Service or the data it provides; or (e) resell, sublicense, or redistribute reports generated by the Service without our permission.
Rent value reports generated by the Service are estimates based on the information you provide and third-party data, run through our calculation methodology. They are provided for informational purposes only and do not constitute an appraisal, financial, legal, or professional advice, and should not be relied upon as the sole basis for any leasing, financial, or business decision. Third-party data used to generate your report may contain inaccuracies outside of our control, and actual market conditions may differ from the report's estimate.
The Service, including its software, design, methodology, and content (excluding information you submit and third-party data), is owned by Inoak Chapman Street, LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service and any report you receive for your own personal or internal business purposes.
The Service relies on data from third-party providers to generate reports. We do not control and are not responsible for the accuracy, completeness, or availability of third-party data, and such data may change or become unavailable at any time.
THE SERVICE AND ANY REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY REPORT WILL BE ACCURATE OR COMPLETE.
TO THE FULLEST EXTENT PERMITTED BY LAW, INOAK CHAPMAN STREET, LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY REPORT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. You may stop using the Service and request deletion of your account at any time.
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time; if we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles, unless otherwise required by applicable law.
